New California Law Limits Ability of Some Professionals to Settle Confidentially

Sacramento, California – December 27, 2012.  California Assembly Bill 2570 prohibits some licensed professionals from adding “gag orders” to civil suit settlements that prevent consumers from working with government agencies or authorities conducting investigations of wrongdoing.  AB 2570 has been signed into law by the governor and will go into effect on January 1, 2013.

For licensed professionals covered by the new law, special attention will need to be paid to the terms of a settlement requiring confidentiality.   If a licensed professional settles a case in violation of the new law, he or she may be subject to disciplinary action by the board, bureau, or program governing his/her field.
