Meyers Fozi, LLP Attorney, Neal Meyers, Wins Trial Verdict in Construction Contract Case

San Diego, California – May 7, 2014.  Carlsbad attorney Neal S. Meyers, of Meyers Fozi, LLP, represented a general contractor in a construction dispute against a tile and stone subcontractor arising from a custom home project in Hawaii.  Trial of the case was before Hon. Kevin Enright in the San Diego Superior Court.  The general contractor claimed the subcontractor breached its subcontract by abandoning the job before completion, causing additional costs to complete the project.  The subcontractor cross-complained under theories of fraud, breach of contract, estoppel and unjust enrichment.  After a week-long bench trial, Judge Enright awarded the general contractor $73,241.50 for breach of contract damages.  After trial, additional sums were awarded for the general contractor’s attorney’s fees and costs – bringing the total judgment for our client to $133,000.
